GENERAL TERMS AND CONDITIONS

Article 1 – Scope

These General Terms and Conditions apply to all offers, orders, contracts and services provided by Go2Logistika d.o.o. (hereinafter: the Company).

By accepting an offer or upon commencement of a service, the Client is deemed to be familiar with these Terms and to accept them in full.

Article 2 – Status of the Company

The Company acts solely as a freight forwarder.

The Company does not carry out transport with its own vehicles and is neither a carrier nor a contractual carrier, unless expressly agreed in writing.

The Company is liable solely for the careful selection of carriers and other subcontractors (culpa in eligendo).

The Company shall not be liable for the performance, omissions, negligence or insolvency of carriers, drivers or other third parties involved in carrying out the transport.

Article 3 – Exclusion of Liability

The Company shall not be liable for:

• theft of the vehicle or goods
• robbery, fraud or criminal acts of third parties
• loss of or damage to goods during transport
• delay in delivery
• seizure, detention or prohibition of disposal of goods by state authorities
• indirect damage, loss of profit, loss of market or any consequential damage

Article 4 – Limitation of Liability

Should the Company be held liable, its liability is limited to the amounts prescribed by the applicable international conventions (CMR, Montreal Convention, CIM, Hague/Hague-Visby Rules).

In any event, the Company's total liability is limited to a maximum of EUR 5,000 per incident, unless otherwise expressly agreed in writing.

Information on the value of the goods does not increase the Company's liability without an express written agreement.

Article 5 – Client Obligations

The Client is obliged to provide complete, accurate and timely information about the goods.

The Client is liable for damage resulting from inaccurate, incomplete or late information.

The Client is obliged to package the goods properly in accordance with their nature and the mode of transport.

Article 6 – Insurance

Cargo insurance is not included in the price of the service.

Insurance of goods is arranged solely upon the Client's express written request.

The Company holds professional liability insurance, which in no way constitutes an extension of the Company's statutory or contractual liability.

Article 7 – Payment

The payment term is 30 days from the invoice date.

In the event of late payment, statutory default interest shall be charged.

The Company has a right of retention over the goods and related documentation until all outstanding claims have been paid in full.

Article 8 – Limitation Period

All claims against the Company, regardless of their legal basis, become time-barred within 6 months from the day the Client learned or should have learned of the damage, and no later than 12 months from the performance of the service.

Article 9 – Governing Law and Jurisdiction

All contractual relationships are governed by the law of the Republic of Croatia and applicable European Union regulations.

The court with subject-matter jurisdiction in Zagreb shall have jurisdiction over all disputes.
