GENERAL TERMS AND CONDITIONS

Article 1 – Scope

These Terms apply to all services provided by the Company.

Acceptance of an offer or commencement of services constitutes full acceptance of these Terms.

Article 2 – Legal Status

The Company acts solely as a freight forwarder.

The Company does not operate own vehicles and is not a carrier or contractual carrier unless expressly agreed in writing.

The Company is liable only for careful selection of carriers (culpa in eligendo).

The Company shall not be liable for the carrier’s performance or omissions.

Article 3 – Exclusion of Liability

The Company shall not be liable for:

• theft of vehicle or goods
• criminal acts of third parties
• loss or damage during transport
• delay
• seizure or detention by authorities
• indirect or consequential damages

Article 4 – Limitation of Liability

Liability, if any, shall be limited to applicable international conventions (CMR, Montreal Convention, CIM, Hague Rules).

In any event, total liability shall not exceed EUR 5,000 per incident unless expressly agreed in writing.

Declared value does not increase liability without written agreement.

Article 5 – Client Obligations

The Client must provide accurate and complete information.

The Client is liable for damages caused by incorrect or incomplete information.

Article 6 – Insurance

Cargo insurance is not included and is arranged only upon explicit written request.

The Company maintains professional liability insurance which does not extend its contractual liability.

Article 7 – Payment

Payment term is 30 days from invoice date.

Statutory interest applies in case of delay.

The Company has a right of retention over goods and documents until full payment.

Article 8 – Limitation Period

All claims against the Company shall become time-barred within 6 months from the date the Client became aware of the damage and no later than 12 months from performance of the service.

Article 9 – Governing Law

Croatian law applies.

Court of jurisdiction: Zagreb.
